“RIPA” Reimbursement Limited for April 2021 & February 2022 Claims

As you may be aware, a limited number of cities and counties are eligible to claim reimbursement for Racial and Identity Profiling Act (RIPA) costs.  This is a result of the State of CA phasing-in the requirements of AB 953 by the number of sworn officers employed by Law Enforcement Agencies (LEAs):

-FY 2018-19 – LEAs that employ > 999 peace officers begin collecting data on/before 7/1/2018, and shall issue its 1st reports by 4/1/2019. (Affects 7 Counties and 4 Cities)

-1/1/2019 — 6/30/2019 – LEAs that employ > 666, but < 1,000 peace officers begin collecting data on/before 1/1/2019, and shall issue its 1st reports by 4/1/2020. (4 More Counties; 3 More Cities)

-FY 2020-21 – LEAs that employ > 333, but < 667 peace officers begin collecting data on/before 1/1/2021, and shall issue its 1st reports by 4/1/2022. (6 More Counties; 5 More Cities)

-FY 2021-22 – LEAs that employ < 334 peace officers shall begin collecting data on/before 1/1/2022, and shall issue its 1st reports by 4/1/2023. (Everyone else)

Only 11 County Sheriff Departments and 7 Police Departments will be able to file claims for FY 2018-19 and FY 2019-20 for the initial deadline of April 21, 2021. For the FY 2020-21 Annual Deadline of February 2022, 17 County Sheriff and 12 Police Departments will be eligible. The remaining and vast majority of the Sheriff (41 Counties out of 58) and Police Departments (320 out of the 332 City Police Departments) will become eligible for reimbursement in Fiscal Year 2021-22 and those claims will be due in February 2023.

The Most Significant Eligible Activities include:

-One-time training per peace officer and supervisor assigned to perform RIPA Act collection and reporting of data on all applicable stops.

-One-time installation and testing of software necessary to comply with the RIPA Act requirements for the collection and reporting of data on all applicable stops.

-Collection and reporting data on all stops, as conducted by that agency’s peace officers.

-Electronic submission of data to DOJ and retention of stop data collected.

-Audits and validation of data collected.
